Terms of Service

1. Introduction and Scope

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User") and Purple Vest Capital ("Firm," "We," "Us"). By creating an account, you acknowledge that you have read, understood, and agreed to these Terms, including our separate Fee Schedule and Risk Disclosure.

2. Account Registration and KYC/AML

To comply with SEC and international AML (Anti-Money Laundering) regulations, all users must provide accurate, current, and complete information during the Know Your Customer (KYC) verification process.

  • Verification: Purple Vest Capital reserves the right to restrict account access or freeze funds where verification documents are suspected to be fraudulent, incomplete, or otherwise non-compliant.
  • Prohibited Jurisdictions: We do not offer services to residents of countries currently subject to OFAC sanctions or equivalent international restrictions.

3. Trading and Investment Risks

  • Volatility: Digital assets and equities are subject to significant and unpredictable market volatility. By using our platform, you acknowledge that you may lose some or all of your principal investment.
  • No Fiduciary Duty: Unless explicitly stated in a premium managed-account agreement, the relationship between Purple Vest Capital and the User does not constitute a fiduciary duty beyond the execution of directed trades.
  • Technical Failures: Purple Vest Capital shall not be held liable for losses arising from third-party exchange outages, blockchain network disruptions, forks, or internet service failures beyond our reasonable control.

4. Asset Recovery Engagement

Users seeking recovery of lost or inaccessible assets must execute a Limited Power of Attorney (LPoA) authorising our forensic team to act on their behalf in engagements with exchanges and relevant law enforcement authorities.

  • Evidence Submission: The User is required to provide all requested transaction hashes (TXIDs) and relevant historical data in a timely manner to support the recovery process.
  • Third-Party Fees: Any legal fees, exchange fees, or un-staking costs incurred during the asset recovery process remain the sole responsibility of the User.

5. Intellectual Property

The Purple Vest Capital name, logos, proprietary trading algorithms, and platform dashboard interface are the exclusive intellectual property of the Firm. Any unauthorised reproduction, scraping, reverse engineering, or commercial use of our materials is strictly prohibited and may result in legal action.

6. Termination of Service

Purple Vest Capital reserves the right to suspend or terminate any user account at its sole discretion and without prior notice, for reasons including but not limited to: suspicious or fraudulent activity, market manipulation, violation of applicable law, or material breach of these Terms.
